Governor Abbott Proposes Strict Regulatory Guardrails for Data Centers

Following a major backlash from Texas residents (who vote), the state is pivoting toward more industry oversight to get a handle on the surge in artificial intelligence development, and the energy the centers require. According to the Texas Tribune, Governor Abbott has issued regulatory guidelines intended for legislative action during the 2027 session. The goal of the proposals is to ensure that big tech covers the cost of its electricity demands instead of Texas residents.

Grid Contributions

New computing hubs must introduce new energy generation resources directly into the state power network.

Self-Funded Infrastructure

Data centers must completely cover the cost for their own grid interconnections and physical hookup expenses.

Water Conservation

Facilities must implement recycling "closed loop" systems that draw water once and continuously reuse it over multiple years.

Transparency and Compliance

Operators must submit mandatory annual data detailing water and electricity consumption amounts.

Community Safeguards

The state will establish baseline noise, light pollution, and operational rules to address neighborhood disruptions.

Tax Reform

State leaders plan to eliminate long-standing sales tax breaks and unnecessary corporate incentives.

Local Pressure

Rural communities are getting the short end of the stick in the data center issue. The centers have targeted rural areas due to the large tracts of land available, but also because there is less red tape. Local municipalities do not have the regulations and protections in place that are found in incorporated areas. Some rural areas have been bombarded with multiple projects at once and are asking the Governor for an immediate special legislative session to address the issue before 2027.

Deadline

Governor Abbott ordered the Public Utility Commission to implement rules by July 31 forcing data centers to absorb all independent electrical infrastructure costs. The utility commission and ERCOT must also deliver a comprehensive safety and cost-mitigation report by mid-July, establishing corporate accountability for the state's tech sector.
